Welcome to FIFTEEN THIRTY FORTY. By participating in any of our events, including tennis classes, clinics, tournaments, and more (collectively, "Activities"), you agree to the following policies. These policies ensure that all participants enjoy a smooth and safe experience. Please review them carefully.

Event Cancellation and Refund Policy:
FIFTEEN THIRTY FORTY understands that situations may arise that prevent you from participating in our tennis classes, clinics, tournaments, or other events. We offer refunds according to the following policy, minus any processing fees incurred.
 

• Rescheduling and Cancellation: You can reschedule or cancel your registration through your online account up to 24 hours before the event. Any changes or cancellations within this 24-hour period will not be eligible for a refund.

• Refund Processing: Refunds will be processed within 7-10 business days to the original payment method, minus any processing fees.

• Exceptions: Refunds may be granted outside of this policy for documented medical emergencies or if the event is cancelled due to weather. Please contact us for consideration of your situation.

Liability Waiver

This Liability Waiver ("Waiver") applies to your participation in any event, tournament, clinic, lesson, or other activity (collectively, "Activities") offered by FIFTEEN THIRTY FORTY or any of its affiliates (collectively, "Organizers").
 

Assumption of Risk and Release of Liability:
 

• Broader Scope: In consideration of being allowed to participate in the Activities, you, the undersigned participant ("Participant"), hereby acknowledge and voluntarily assume all risks associated with participating in such Activities.

• Minors with Parental Permission: If Participant is under the age of 18, their parent or legal guardian ("Parent/Guardian") also agrees to this Waiver on Participant's behalf and acknowledges their full responsibility for Participant's actions and safety during the Activities.

• Inherent Risks: You/We fully understand and acknowledge that participation in the Activities involves inherent risks, including but not limited to:

  • Physical exertion to the full extent of your/Participant's capabilities.

  • Contact with other participants, equipment, or the playing surface.

  • The potential for serious injury, illness, or death.

• Release of Liability: You/We hereby release, discharge, and hold harmless FIFTEEN THIRTY FORTY, its affiliates, and any partners or organizations affiliated with the Activities (collectively, "Released Parties"), along with their respective owners, directors, officers, employees, agents, volunteers, and affiliates, from any and all claims, demands, actions, or causes of action, whether known or unknown, anticipated or unanticipated, arising out of or related to any loss, damage, or injury, including death, that may be sustained by you/Participant or to any property belonging to you/Participant while participating in any Activities.

• Indemnification: You/We agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable attorney fees) arising out of or related to Participant's participation in any Activities, including but not limited to claims arising from the negligence of any of the Released Parties.
   

Medical Consent:
 

• Confirmation of Fitness: Before participating in any Activities, you/Parent/Guardian confirm that Participant is in good physical condition to engage in such activity and has no medical conditions that could be aggravated by such activity.

• Responsibility for Medical Decisions: You/Parent/Guardian understand that it is your/our responsibility to seek medical attention for Participant if needed during or after the Activities.
   

Photography and Media Consent:
 

• Grant of Rights: You/Participant grant FIFTEEN THIRTY FORTY and its affiliates the irrevocable, worldwide, royalty-free right to use any photographs, motion pictures, recordings, or other media of you/Participant taken during your/Participant's participation in any Activities for promotional purposes, advertising, marketing, or any other lawful purpose.

• Minor's Media Consent: If Participant is under the age of 18, Parent/Guardian also grants this media consent on Participant's behalf.

Additional Considerations:
 

• Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

• Severability: If any provision of this Waiver is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

• Entire Agreement: This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
   

Acknowledgment:

You/We have carefully read this Waiver and fully understand its contents. You/We voluntarily agree to its terms and conditions, and you/we acknowledge that you/we are giving up substantial rights, including your/our right to sue.

By registering for an Activity, Participant (and Parent/Guardian if applicable) acknowledges their agreement to the terms of this Liability Waiver.
